Section 2 of the Illinois Open Meetings Act lists 24 exceptions to closed meetings. Among those exceptions is personnel discussion regarding "employees."
The statute, with emphasis in bold added, reads, "'Employee' means a person employed by a public body whose relationship with the public body constitutes an employer-employee relationship under the usual common law rules, and who is not an independent contractor."
The board agenda, superintendent and board president agree that Carol Loy was no longer an employee and was being considered as an independent contractor.
