SPRINGFIELD — There’s not enough support in the Illinois Senate to impose tough new restrictions on semiautomatic weapons and high-capacity ammunition clips.

In a setback for gun-control advocates in the wake of the killings of school children in Connecticut, the Illinois Senate was poised to adjourn Thursday without voting on two pieces of legislation aimed at limiting access to certain kinds of weapons and bullets.

Although the two proposals could emerge again when the legislature reconvenes next week, the lack of action shows the General Assembly remains divided on how to balance Second Amendment issues.

A spokeswoman for Senate President John Cullerton, D-Chicago, offered no timetable for when the gun safety proposals might surface again.

“We will take some time to work on these important issues to advance them in the near future,” Rikeesha Phelon noted in a message to reporters.

One proposal would restrict the possession, delivery, sale and transfer of semiautomatic weapons, including handguns and rifles.

The National Rifle Association lobbied against the measure, saying the ban would take as many as 50 percent of long guns off the market in Illinois. Gun manufacturers also said the proposal could force them to lay off workers.

The legislation, sponsored by Sen. Antonio Munoz, D-Chicago, would allow people who currently own such weapons to keep them as long as they register the firearms with the Illinois State Police.

Sen. Dan Kotowski, D-Park Ridge, sponsored the proposal that would limit ammunition magazines to 10 or fewer rounds.

Gov. Pat Quinn has pushed for a ban on assault-style weapons, but a spokeswoman recently suggested action could come later this spring.

Here are some of my ideas of good laws to pass for better "gun control" and to deter violent people from getting access to a weapon easily:


1. Give Sheriff's a procedure by which to search and confiscate any weapons from the homes of people convicted of felonies or adjudicated as mentally ill. With exceptions for other family members that own weapons that keep them "locked securely" with their sole access.
2. Have a better mental health database linked to the purchase checks for gun buyers.
3. Require doctors to enter patients into the database that have homicidal ideations or tendencies so they cannot buy weapons.
4. Require private sales or transfers of firearms to go through a FFL licensed dealers for a small fee for non-related individuals. This would do away with the flea market/gun show loop-hole.
5. More access to mental health care and evaluations.
6. Make it illegal to sell or give access to children under the age of 14 violent video games marked MA (mature) or V (violent).
7. Make a school security division of Homeland Security and offer federal money to assist schools to hire armed security guards.
8. Let retired law enforcement officers be exempt from re-training for school armed school security positions.
9. Require an onsite signature and ID check for private ammunition purchases of over 1000 rounds. Clubs, schools, organizations, businesses would be exempt.
10. Offer a tax break on the purchase of home gun safes to encourage their purchase and use.
11. Make it illegal for anyone who is a convicted felon or who has been involuntarily committed to own, buy or possess ammunition or ammunition components.

***Don't make anything pre-existing illegal. We don't need to make a bunch of criminals out of law-abiding citizens.

Remember, violent crimes, homicides and firearm-related crimes are at there lowest in 20 years. The murder rate of 4.8 per 100,000 (2010 figures) has not been this low since 1963. Only 9 RIFLES were used in 190 firearm homicides in Virginia in 2011 and some of those were negligent manslaughter hunting. Homicides using firearms has dropped over the past 20 years (FBI UCR Stats). The sky is NOT falling. When these mass murders, rare that they are, take place it is ALWAYS against unarmed, unprotected, defenseless victims! Otherwise the killers wouldn't be percieved as these efficient killing machines. They wouldn't last 15 seconds against a cop or a real soldier.

1. This one could be problematic, since the search must satisfy the 4th amendment, but if a method could be found it could be supported.
2. For those adjudicated mentally ill I can agree, I would be concerned that simply going in for counselling could somehow then restrict your rights.
3. Perhaps, but you need to be careful, rights should not be restricted without due process, perhaps a timed restriction could be workable.
4. Honestly I think the gun show loophole is overstated, while there are some private sellers at gun shows there aren't that many. But as long as the transfer fee is limited to $20 or less this could work..

Everyone would do well to know The Constitution but it's not necessary to cite it. You need to go further. The Supreme Court, and specifically Judge Antonin Scalia, has already upheld the 2nd Amendment in Mack vs. The People. The decision specifically states that THE COUNTY SHERIFF is the final word on all matters relating to guns. Therefore, the Sheriff can ignore any Federal or State legislation or bans on firearms, if he/she feels it is unconstitutional, so that government cannot impose its will on that Sheriff's citizens. What about "shall not be infringed" is not understood by a whole large number our representatives and senators at both the State and National levels?

Now we need to address the next issue that this has created. All of the elected officials who supported this bill have CLEARLY AND DIRECTLY VIOLATED THE OATH THEY WERE SWORN IN UNDER. They clearly tried to pass a law that would infringe on the rights of the people, and not just in the Constitution of the United States, but also the Illinois State Constitution. By going against this oath which is listed under Section 3 of Article 13 of the Illinois State Constitution, those who partook in these activities should be relieved of their duties and disbarred from office under account of committing perjury as stated under Section 1 of Article 13 of the Illinois State Constitution. These officials took an oath of law, which they then chose to violate, thus meaning they have committed perjury.

Hate to break it to ya fella, but that is not true. The magazine feeds the gun and the clip feeds the magazines on some guns. It has nothing to do with capacity... Take "strip clips" for example, they are used to quickly reload magazines in a quicker fashion... So... CDC exposes gun-control myths

The Centers for Disease Control, an agency of the federal government, has conducted studies of many of the gun-control laws in place, such as waiting periods, registration, and bans on certain types of firearms. The results showed that the idea that gun control laws have reduced violent crime is simply a myth. The CDC is hardly a shill for the NRA. Political trends throughout the country have reflected the growing realization by the majority of Americans that restricting the rights of law-abiding citizens is not only ineffective as a means of combating crime, but counter-productive. All of the research over the last few decades bears this out. (One of many excellent sources is “More Guns; Less Crime” by former University of Chicago and current Harvard professor, John Lott).

What the backers of this legislation have proposed is in direct conflict with both the Illinois State and US Constitutions. It's just that simple. And, if we want to see how effective such a Draconian ban would be, let's just ask Chicago how that murder rate is working out for them...or Mexico. With your logic then, you should have the right to buy a rocket launcher, or a nuclear bomb if you want. The second amendment says "the right to bear arms shall not be abridged". Please explain how denying you the right to bear a rocket launcher. or nuclear bomb is NOT an abridgment of the right to bear arms. You can't of course. The truth is NO right is absolute. EVERY right has limits. I know you don't like that, but it the reality.

Nobody said that there can be no limits on what armaments a citizen may own. Who here claims a right to own a rocket launcher? You are the one that does not like the reality I am pointing out. And that reality is this: certain lawmakers in Illinois (and on the national stage) seek to strip citizens' rights, guaranteed under the state and US Constitutions, to own firearms. Many of these lawmakers have an obvious end game: effectively eliminate private gun ownership. You know this is true. I know this is true. We all know this is true. Call it the Feinstein plan...and she's stated her aims plainly. You'll be happy to know I just made a donation to the NRA Institute for Legislative Action in your honor. The NRA thanks you for the impetus you provided. Now take your red herring and go home.

I think it is high time that we addressed this issue without delay and I am grateful to the Democrats for their courage and conviction. According to the government, 323 people were killed by rifles in 2011. That is an outrageous number and something needs to be done about such senseless and brutal loss of life. The same government report also noted that 496 innocent men, women and children were killed by hammers and clubs. In the interest of public safety, this vital and needed regulation should be expanded to include the ban of any hammer by anyone not a licensed construction professional. It is high time to stop the slaughter. Contact your congressman today.

Yes, hammers and clubs and automobiles are murderous and should be banned. I would also suggest banning spiders, hornets, and bees as these also kill. But, worst of all, are hospitals where Iatrogenicity kills a recorded 783,000 people annually. See here:

More people were killed with clubs and hammers than guns, according to the FBI. Good luck trying to subvert the Constitution. The State of Illinois is already under a court order to implement concealed carry in the next 180 days. 323 people killed by rifles? Not many at all. Many more die in auto accidents and misadventure. Tens of thousands die from drug abuse, but I bet you are against the war on drugs.

This is nothing more on the Democratic side to use warm and fuzzy knee jerk legislation that has absolutely no impact on crime that makes Jane & John Doe Smith the honest citizens criminals, but most of all just to get the votes to stay in office.

Good, anyone who voted for these gun bans are treasonists to this Country. America isn't going to let these types take away our rights. And we're getting sick of the bull these gun grabbers keep throwing at America, they need to focus on things that actually matter.

No one from downstate (Democrat or Republican) who voted for this would be re-elected. Chicago politicians act as though they own the state, but it just isn't so. If Chicago politicians want a ban like this for Chicago, let them enact it in Chicago. Leave the rest of the state alone.
