CAMBRIDGE, Ill. — A semi driver from Texas will see a charge of violating the Illinois motor carrier law move forward in Henry County Circuit Court following a preliminary hearing on the charge Monday.
David L. Ellis, 48, of Frankston, Texas, was charged with a Class 4 felony after Illinois State Police were called to a crash at Interstate 74 milepost 14 on Oct. 11.
Illinois State Police Trooper Andrew Scott said he detected the odor of alcohol on Ellis' breath and a search found a 12-ounce bottle of Budweiser on the ground outside the cab, matching a bottle located in the cab. Scott said the contents were still carbonated.
Ellis was taken to a hospital where a portable breath test showed a reading of .07.
Judge Terry Patton found probable cause to believe a felony was committed and set a Nov. 8 pre-trial hearing. Ellis remained in custody Monday on $25,000 bond.
